Islamic Jurisprudence rulings based on the Hanafi school of thought.
Most of the rulings are based on women's issues and general everyday issues answered by a qualified Aalim or Aalimah.

The Purificatory Bath (Ghusl)

The fard /obligatory acts of ghusl are:
    •  Gargle out the mouth once
    • Washing inside the nose once
    • To wash the entire body once

    Note:

    • Washing everything that is possible without causing undue hardship
    •  Removing any obstacles that stop the water from reaching
    • E.G nail varnish, paint, dough, etc
    •  Men have to undo braids/plaits
    • Women do not undo braids/plaits as long as water reaches the scalp/root of the hair

2. Sunnah Acts Of Ghusl: Major Bath

Begin with saying Tasmiyyah  بِسْمِ اللهِ الرَّحْمٰنِ الرَّحِيْمِ Bismillahirrahmaanirrahim- In the name of God, the Most Gracious, the Most Merciful

  • Begin with washing hands to wrist & genitals.
  • Remove any filth on the body.
  • Perform Wudu- like the wudhu of Salaah, except for feet.
  • Pour water over the rest of his body 3 times or long enough for a proper wash starting from the head.
  • Step aside from that place and then wash his feet.
  • Submerging oneself into clean/pure water washes the body.
  • Women can keep their plaits/ braids (As long as the water reaches the roots)
Manners/etiquettes of ghusl are:‎
  • The same manners as in wudhu/ablution,‎
  • With the exception that:
  • One does not face the qibla
  • No speaking is allowed
  • The actions disliked in the ablution are disliked in the purificatory bath.‎

What obligates Fard / major bath?

  • The discharge of sperm/ wet dream
  •  If the head of the penis disappears in one of the passages vagina or anus, for both husband & wife
  • Perform the major bath after embracing Islam- If he has had these conditions before
  • It is fard kifaya (a communal obligation) to bath a deceased Muslim
  • When a woman comes to the end her period (Haid) or post-natal bleeding (Nifas)

I am heavily pregnant and praying is difficult, do I still have to pray?

Prayer for pregnant mothers can be difficult but there are concessions that can make it easier. Prayer for a pregnant woman can be done in a way that does not cause too much difficulty to the mother.

It remains obligatory for a pregnant woman to pray: if she can pray to stand, she must; if she can’t do so without genuine hardship or unbearable pain, then sitting down on the ground, with prostration; if she can’t, then sitting with head motions, but she must pray.

The Messenger of Allah (Allah bless him and give him peace) told us that the first deed the believer will be asked about on the Day of Judgment is their prayer.

Fasting whilst pregnant and breastfeeding

There is no condition that prohibits a woman from fasting during pregnancy or breastfeeding.

Women in this state are not excused to miss their fast without a valid reason.

Nevertheless, an allowance has been given to a pregnant woman to miss her fast due to her state.

If the baby or the mother’s health is at risk, then the mother should seek medical advice from a reliable doctor, ideally a practicing Muslim doctor, and adhere to the advice given accordingly.

The great 7th Century Hanbali Scholar Ibn Qudama writes in his famous work, Al Mughni, ‘the pregnant and nursing women when they fear harm upon themselves (by fasting), can refrain from observing the fast (in Ramadhan), but must make Qadha of the fast (that is, they must make up for the missed fast afterward). And there is no known difference of opinion among the scholars of the four madhabs in this.

If she does not keep the fasts due to her excuse, then she has to make up for the missed fasts when she is in better health.

Does a woman pay Fidya (expiation) for missing fasts in Ramadan whilst pregnant or breastfeeding?

In the Hanafi school of thought (madhab), a woman who missed her fast due to an excuse such as pregnancy or breastfeeding only, has to make up the missed fasts when she is able to.

There is no time limit to when she needs to make up the fasts, but the sooner the better as this remains an unfulfilled qada’(duty to make-up) upon her. There is no expiation (fidya) upon her.

However, there is a difference of opinion among the other madhabs regarding the payment of fidya.

Duas for wealth

If we want to increase our wealth in this dunya, we should recite Surah Waqiah regularly after Maghrib salah or after Isha salah.

The Prophet ﷺ said, ‘Surah al Waqiah is the Surah of wealth, so recite it and teach it to your children’[Ibn Asakir]

It is recorded in Shu’ab al-Iman of Imam Bayhaqi:

  عن ابن مسعود قال قال رسول الله صلى الله عليه وسلم: من قرأ سورة الواقعة في كل ليلة لم تصبه فاقةً أبدًا، وكان ابن مسعود يأمر بناته يقرأن بها كل ليلة .

 Abdullah Ibn Masood R.A narrated that the Messenger of Allahﷺsaid, “Whoever recites Surah Waqiah every night, he will never be afflicted by poverty. And Ibn Masood R.A used to order his daughters to read it every night.”

(Shu’ab al-Iman 4/120, number 2269).

Also read the following dua regularly after each fard salah:

  اللَّهُمَّ اكْفِنِي بِحَلَالِكَ عَنْ حَرَامِكَ وَأَغْنِنِي بِفَضْلِكَ عَمَّنْ سِوَاكَ.

 O Allah, you suffice me with halal and make me independent from Haraam, and through your grace make me self-sufficient and independent of everyone besides you.

Making duas for the best of both worlds

We should make a habit of making duas for good for ourselves in the world along with the hereafter and asking Allah to save us from the punishments of the hereafter.

We should recite this Dua from the Quran regularly, with sincere devotion and faith in Allah

 رَبَّنَا آتِنَا فِىْ الدُّنْيَا حَسَنَةً وَفِىْ الآخِرَةِ حَسَنَةً وَّقِنَا عَذَابَ النَّارِ

 Rabbana atina fid-dunya hasanatan wa fil aakhirati hasanatan waqina ‘adhaban-nar

(Our Lord, give us good in this world and in the Hereafter, and protect us from the torment of the Fire) [Surah Al-Baqarah: 201]

Anas R.A said that the Messenger of Allah ﷺ visited a man from amongst the Muslims who had become weak and fragile like a bird. The Messenger of Allah ﷺ asked him, “Were you making du’a for anything or asking Allah for something?” He said, “Yes, I used to pray: ‘O Allah, the punishment that You are going to give me in the Afterlife, bring it forward to this world.” The Messenger of Allah ﷺ said, “SubhanAllah, you can’t bear it. Why did you not say: “Our Lord, give us good in this world, and good in the Hereafter, and protect us from the torment of the Hellfire?” The Prophet then prayed to Allah for him, and he was cured.

(Imam Muslim reported it.)

From the above hadith, we can understand the importance and the validity of making duas. We have to be careful and not make duas with the haste of punishment etc.

We should always pray for good from Allah, as Allah is Al-Razzaq, he is Al Mujeeb- the provider, the responder.

He will give us the best of both worlds. Insha’Allah.

Rewards of fasting

Nabiﷺ said:

“Every good deed of the child of Adam is increased (in reward) from ten to 700 times”. Sunan Ibn Majah

And Almighty Allah says: “Except fasting, for verily it is for me and I will reward it. The fasting person abstains from desire and food for my sake”

Nabiﷺ mentioned:

“Whoever fasts in Ramadan with Iman and hopes for reward from Allah, all his past sins will be forgiven”. (Mishkat)

Nabiﷺmentioned:

There are two occasions of joy for a fasting person,

a) pleasure at the time of breaking the fast and

b) at the time when he will meet his Rabb. (Tirmizi)

Nabiﷺ mentioned:

“Whoever does any good in Ramadan, will get the reward of doing a Fard act out of the month of Ramadan and whoever does a fard act in Ramadan, will get the reward of doing 70 Fard acts. (Mishkat)

Fasting The Month Of Ramadan Is One Of The Five Pillars Of Islam

عَنْ أَبِي عَبْدِ الرَّحْمَنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُمَا قَالَ: سَمِعْت رَسُولَ اللَّهِ صلى الله عليه و سلم يَقُولُ: ” بُنِيَ الْإِسْلَامُ عَلَى خَمْسٍ: شَهَادَةِ أَنْ لَا إلَهَ إلَّا اللَّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ، وَإِقَامِ الصَّلَاةِ، وَإِيتَاءِ الزَّكَاةِ، وَحَجِّ الْبَيْتِ، وَصَوْمِ رَمَضَانَ”. [رَوَاهُ الْبُخَارِيُّ]

The Sahabi Abdullah Ibn Umar Ibn Al-Khattab R.A Said,

“I heard the Messenger of Allahﷺsay:

‘The religion of Islam is based upon five (pillars): Testifying that there is no deity except Allah and Muhammad is the Messenger of Allah; establishing the prayer; giving zakat; making the pilgrimage, and fasting (the month) of Ramadan.’

11. Ghusl for women

The ghusl is a purificatory shower that can be obligatory (fard) or sunnah to perform.

Taking a ghusl is obligatory in order to exit a state of major ritual impurity.

The situations that necessitate taking the ghusl are:

  • after engaging in marital relations,
    • even if ejaculation did not occur
  • after ejaculating or climaxing
    • through foreplay
    • wet dreams,
    • or the like
  • after menstruation (haidh) ends
    • The menstrual maximum of 240 hours is reached (10 days)
  • after lochia, post natal bleeding (nifas) ends
    • Post natal bleeding maximum of 960 hours is reached (40 days)

Proofs for The Permissibility of Al-Tayammum

Allah says :

… and when you don t find water, then perform at tayammum with clean earth and rub your faces and hands with it.
(AlMa idah: 6)

The Prophet صلى الله عليه وسلم said:
“ I have been given five things which have not been given to anyone else before me: Allah made me victorious by causing my enemies to fear me up to a distance of one month s journey, and the earth has been made for me (and my followers) a place for praying and a means to perform Tayammum (to purify oneself for prayer). Therefore, anyone (of my followers) can pray (anywhere) and at any time that the Salat (prayer) is due.”
[ narrated by Al Bukhari.]

This indicates the ease of the religion of Islam; as mercy for us, as previously in the earlier religions prior to Islam, they entailed many instances of hardship that were very difficult and hard be tolerate, except by those whom were really devout. However, with the arrival of Islam came teachings that help us and keep us in constant connection between Allah SWT.

We, the worshippers, the servants of the lord of the universe have the opportunity to be present with Allah in all circumstances!

لَا يُكَلِّفُ اللَّهُ نَفْسًا إِلَّا وُسْعَهَا لَهَا 
Allah does not burden any human being with a responsibility heavier than he can bear. (Baqarah 2:286

Acts of worship that cannot be valid without wudu

the act of:
▪Prayers
▪Touching the Qur’an (Hanafi)
▪Tawaf
▪Sujood tilawaah etc

However, the Sacred Law allowed tayammum as a substitute for water during its absence or when water is unable to use.
This was done so that the worshippers would not be restricted from the acts of worship or receiving its benefits and rewards.

 “O you who believe! When you intend to offer prayer, wash your faces and your hands (forearms) up to the elbows, rub (by passing wet hands over) your heads, and (wash) your feet up to the ankles. If you are in a state of major impurity, bathe your whole body. But if you are ill or on a journey, or one of you comes from a nature call, or you have been in contact with women, and you find no water then take for yourself clean sand or earth, and rub with it your face and hands. God does not wish to place you in difficulty, but to make you clean, and complete His favor to you, that you may be grateful” (Quran, 5:6)

4 Pillars of wudhu (4 fard)

  • Wash Face
  • Wash Arms Inc. elbows
  • Wipe Quarter of the head
  • Wash Feet Inc. ankles

The definition of washing is that at least a couple of drops should flow from the limb.

Conditions that validate wudhu

  • Pure water to reach complete outer skin
  • Must cease all things that invalidate wudhu- i.e. menstrual bleeding, urine etc.
  • Remove actual dirt/anything that prevent water reaching body. i.e. wax-fatty grease/ dough

Disliked acts in wudhu

  • To waste water
  • To not use enough water
  • To slap water on the face
  • To speak un-necessarily
  • To seek assistance without reason
  • To wipe the head x3 with fresh water each time

That which Does Not Nullify Wudu

  • The appearance of blood that does not flow from its injury
  • flesh or scab is separated from the body without the flowing of blood &om its place
  • If a worm exits a wound, or exits from the ear or nose-
  • Touching one’s penis, anus or a woman’s genitalia
  • Touching a woman- kissing caressing without discharge
  • Vomiting less than a mouthful
  • Vomiting phlegm saliva/mucus
  • To sway while sleeping where there is a possibility of falling does not break wudu
  • Sleeping in a firm mariner is not an annulling factor, even if one is leaning on a support,
  • Sleeping in prayer even if one sleeps during bowing and prostration
    • provided the person maintains his posture according to the sunnah

Fasting can be split into three levels as follows:

1.General: Physical
At this level, a person abstains from food, drink and
sexual intercourse.
2.Mindful: Psychological: A person who reaches the special level does
not only abstain from food, drink and sexual intercourse
but also abstains his tongue from indulging in useless or harmful speech,
abstains his eyes from gazing at inappropriate things and abstains his
hands and feet from doing something that’s not allowed in the Quran and
Sunnah.
3. Extraordinary: Spiritual: At this level, a person has already attained the general and mindful levels of fasting.
Along with those, they also restrain their hearts from moving away from
Allah. They remove all things and desires that would take them away from Allah and are exceptionally focused in filling their hearts with Allah and
getting closer to Him by all means.

That which Does Not Obligate The major Bath

  • Madhi non-sperm male discharge also known as cowper’s fluid
    • Madhi-  It is a white, thin, sticky fluid that is released from a man’s penis when he is aroused. The fluid is released long before man reaches an orgasm.

    • Such arousal is due to passionate or romantic play or kissing.

    • Moreover, the fluid that exits from a female due to amorous play is termed kadhi.’

  • Wadi non-sperm male discharge
    • Wadi- a white cloudy fluid that is thick and warm and has no smell. It is released generally after urinating and occasionally before.

  • Sexual dream but no wetness upon awaking.
  • Giving birth without visible blood
  • If a man inserts his penis in a woman’s vagina, but there is a barrier preventing sexual pleasure
  • Administrating medicine m the anus
  • Inserting a finger or something like it into the vagina or anus
  • Sexual intercourse with an animal or a deceased women without discharging semen
  • Male penetrates a virgin. Though he does not break her hymen and does not discharge semen,

Conditions for wudhu to be fard

  • Sanity  (In your senses)
  • Maturity  (Baaligh age)
    • Girls 9-15 lunar years
    • From the day a girl starts her first periods.
    • Boys 12-15 lunar years)
  • This is from the day the boy has his first wet dream.
  • Islam  (If you are Muslim)

A’ishah R.A related that the Prophet ﷺ  said,

رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنْ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنْ الصَّبِيِّ حَتَّى يَشِبَّ وَعَنْ الْمَعْتُوهِ حَتَّى يَعْقِلَ

“The pen has been lifted from three; “A sleeping man, until he wakes; an immature person until he attains maturity and an insane person until he is restored to his senses.“Sunan al-Tirmidhī 1423

Ritual ablution (wudu) is nullified by:

  • 1. Anything that exits from the private parts, even if it not customary such as a worm or stones.
    • Except wind from the front passage of a woman
  • 2. The flowing of any ritually impure substance (such as blood or pus) from a wound
    • (or other opening) to any place that requires cleaning
    • (i.e. it flowed beyond its point of exit),
    • or if it came out with enough force to flow
    • or it was prevent from flowing because it was wiped or absorbed by a bandage).
  • 3. Vomit that is a mouthful,
    • such that one would not have been able to keep it in without difficulty
    • except if it is just phlegm.
    • Definition of a mouthful is the mouth cannot be shut except with difficulty-
    • or if there are several instances of vomiting which amount to a mouthful or more
  • 4. Blood (from the mouth or throat)
    • that overcomes one’s saliva or equals it
    • if closer to red, wudu is invalidated;
    • if closer to yellow, wudhu is not invalidated
  • 5. The sleep of one whose rear is not firmly seated.
    • As for the one whose rear is firmly seated, his ablution is not nullified by sleep
    •  even if leaning against something in a way that if it were removed he would fall.
    • Light sleep -doesn’t nullify wudhu-  where you are aware and can hear others etc d
  • 6- The elevation of one’s buttocks from the floor while one is sleeping and before one becomes aware, nullifies the wudu even if one does not fall over.
    • To sleep in such a way that one’s buttocks are not firmly set on the ground,
    •  This occurs when a person sleeps while he is in a sitting posture, though his buttocks are not firmly fixed, resulting in the nullification of wudu-
    • due to the relaxation of the muscles and joints.
  • 7. Loss of consciousness.
  • 8. Madness.
  • 9. Drunkenness.

That which Does Not Obligate The major Bath

  • Madhi non-sperm male discharge also known as cowper’s fluid
    • Madhi-  It is a white, thin, sticky fluid that is released from a man’s penis when he is aroused. The fluid is released long before man reaches an orgasm.

    • Such arousal is due to passionate or romantic play or kissing.

    • Moreover, the fluid that exits from a female due to amorous play is termed kadhi.’

  • Wadi non-sperm male discharge
    • Wadi- a white cloudy fluid that is thick and warm and has no smell. It is released generally after urinating and occasionally before.

  • Sexual dream but no wetness upon awaking.
  • Giving birth without visible blood
  • If a man inserts his penis in a woman’s vagina, but there is a barrier preventing sexual pleasure
  • Administrating medicine m the anus
  • Inserting a finger or something like it into the vagina or anus
  • Sexual intercourse with an animal or a deceased women without discharging semen
  • Male penetrates a virgin. Though he does not break her hymen and does not discharge semen,

Conditions for wudhu to be fard

  • Sanity  (In your senses)
  • Maturity  (Baaligh age)
    • Girls 9-15 lunar years
    • From the day a girl starts her first periods.
    • Boys 12-15 lunar years)
  • This is from the day the boy has his first wet dream.
  • Islam  (If you are Muslim)

A’ishah R.A related that the Prophet ﷺ  said,

رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنْ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنْ الصَّبِيِّ حَتَّى يَشِبَّ وَعَنْ الْمَعْتُوهِ حَتَّى يَعْقِلَ

“The pen has been lifted from three; “A sleeping man, until he wakes; an immature person until he attains maturity and an insane person until he is restored to his senses.“Sunan al-Tirmidhī 1423

Ritual ablution (wudu) is nullified by:

  • 1. Anything that exits from the private parts, even if it not customary such as a worm or stones.
    • Except wind from the front passage of a woman
  • 2. The flowing of any ritually impure substance (such as blood or pus) from a wound
    • (or other opening) to any place that requires cleaning
    • (i.e. it flowed beyond its point of exit),
    • or if it came out with enough force to flow
    • or it was prevent from flowing because it was wiped or absorbed by a bandage).
  • 3. Vomit that is a mouthful,
    • such that one would not have been able to keep it in without difficulty
    • except if it is just phlegm.
    • Definition of a mouthful is the mouth cannot be shut except with difficulty-
    • or if there are several instances of vomiting which amount to a mouthful or more
  • 4. Blood (from the mouth or throat)
    • that overcomes one’s saliva or equals it
    • if closer to red, wudu is invalidated;
    • if closer to yellow, wudhu is not invalidated
  • 5. The sleep of one whose rear is not firmly seated.
    • As for the one whose rear is firmly seated, his ablution is not nullified by sleep
    •  even if leaning against something in a way that if it were removed he would fall.
    • Light sleep -doesn’t nullify wudhu-  where you are aware and can hear others etc d
  • 6- The elevation of one’s buttocks from the floor while one is sleeping and before one becomes aware, nullifies the wudu even if one does not fall over.
    • To sleep in such a way that one’s buttocks are not firmly set on the ground,
    •  This occurs when a person sleeps while he is in a sitting posture, though his buttocks are not firmly fixed, resulting in the nullification of wudu-
    • due to the relaxation of the muscles and joints.
  • 7. Loss of consciousness.
  • 8. Madness.
  • 9. Drunkenness.
